Motor City Music Together Terms and Conditions

PLEASE READ THE FOLLOWING INFORMED CONSENT CAREFULLY:

Motor City Music Together, LLC and Leah Celebi, Director strive to provide quality music and movement instruction to and for young children and parents and/or caregivers. Motor City Music Together, LLC and Leah Celebi cannot protect your children and yourselves from unexpected illness or circumstances due to your health status. We also do not own, maintain, or guard the premises on which instruction takes place. We cannot safeguard your person or property before, during or after instruction. We hope that you will participate mindful to your health, person and surroundings. In recognition of the quality instruction we strive to provide and the fees you have and continue to pay for such services, we ask you to acknowledge the following statements for yourself and your child by signing accepting the terms and conditions below.

1.  A certain level of fitness may be required for participation in instruction. Each student, by and through his or her parent(s), each parent and each caregiver certify that each is in good health and has no known medical condition that could endanger their own well being or that of other adults, children, or teachers in the program. Each certifies that she/they have consulted with a physician and determined that participation does not jeopardize his/her/their health. 

2.  I hereby release and forever discharge Motor City Music Together, LLC and/or Leah Celebi, individually, and their respective employees, agents, assignees and other related entities, from any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever arising from any and all injuries, damages or  illness including exposure to contagious disease due to teacher-student proximity, parent-student proximity, or student-student proximity. 

3.   The premises, at which instruction is provided is not owned, inspected, maintained, or controlled by Motor City Music Together, LLC and/or Leah Celebi. Each child, parent and caregiver hereby release, and for him/herself and on behalf of the student if he/she is a minor, waive and discharge Motor City Music Together, LLC and Leah Celebi, individually and their respective employees, agents, assignees and other related entities from any and all liability for any and all loss or damage and any claim for loss or damages arising from the participation or attendance at this premise, to property or per person, even injury or illness or loss or claim which arises out of the condition of the premises, whether such condition is know or unknown. Each participant inspected the location for instruction and is satisfied with the premises condition.

3.  Each child, parent and caregiver or other participant in consideration for participation in the instruction provided by Motor City Music Together, LLC and Leah Celebi, individually hereby releases, and for him/herself and on behalf of the student if he/she is a minor, waives and discharges Motor City Music Together, LLC and Leah Celebi, individually and their respective employees, agents, assignees and other related entities, from any and all liability for and all loss or damage to property or to person and any claim which could not have been anticipated at the time of enrollment or any and all future MT Classes or events attended.


Assumption Of The Risks and Waiver of Liability

All families, whether enrolling in outdoor classes or online classes must agree to the terms set below:

As a willing participant in Music Together/Rhythm Kids with Motor City Music Together, my family and I agree to the following:

ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Motor City Music Together, and present an inherent risk that cannot be eliminated. I acknowledge that, although Motor City Music Together is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together teachers, and third-parties), it is ultimately my responsibility to ensure that I and my child take appropriate actions to safe-guard ourselves, including all adults wearing masks during class. All family members must stay within their personal blanket/ area and ensure that personal instruments/props are not shared between families. I understand and agree that as a registered member of Robinsongs for Kids, I am accepting and voluntarily assuming the risk that I or my child may be exposed and become ill as a result of COVID-19 and other diseases.

WAIVER OF LIABILITY: I, on behalf of myself and my child hereby voluntarily release, forever discharge, and covenant not to sue Motor City Music Together, LLC or the outdoor location owner (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus or COVID-19 or any other accident that may cause harm. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties. I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY ENROLLING IN CLASSES AT MOTOR CITY MUSIC TOGETHER, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.


REFUND POLICY

No refunds will be given after the first class of the session. An administrative fee of $20 will be deducted upon cancellations occuring prior to the start of the semester.

No refunds or credits will be offered for missed classes. Families are responsible for class attendance.  Families who miss individual classes can make them up using our online Zoom class scheduler.

Should the community health situation dictate that it is no longer safe to hold outdoor classes, all classes will be moved online to Zoom. No refunds or credits will be offered for those circumstances beyond our control. 

Weather issues - If the class is cancelled due to rain, heat, or cold temperatures classes will be held on Zoom.  There will be no refunds or credits offered for missed classes.
